The Contingent Fee Contract

A contingency fee contract is contingent, or dependent, upon your attorney recovering an award.

Most cases are taken on a contingency fee basis, meaning that if your attorney recovers an award on your behalf the attorney will receive a percentage of that recovery as payment for legal services. If no award is recovered, you do not owe your attorney any money.

How are attorneys’ fees calculated?

Attorneys’ fees are calculated as a percentage of the gross recovery obtained by a settlement or at trial.

For example, typical attorneys’ fees are 33 1/3%. If your attorney negotiates a settlement of $75,000, the attorney’s fees will come out to $25,000.

What about case expenses?

 

In addition to fees, the client will also owe the attorney all costs and expenses that were advanced during the preparation of your lawsuit.

Case expenses may include, but are not limited to, the cost to file your lawsuit with the court, postage, obtaining documents or records related to your claim and the fees associated with hiring any expert witnesses.

Notably, in a contingent fee contract, if there is no monetary award recovered on your behalf, you will not be required to pay back your attorney for any expenses incurred in your case.
