McDonald Law Firm is evaluating claims for patients who developed serious infection following the use of a 3M Bair Hugger forced air warming blanket during surgery. These devices, which debuted in 1987, have been used widely used across the country during shoulder, knee and hip replacement surgeries.
The lawsuits, filed against 3M Company and its subsidiary Arizant Healthcare, Inc., assert that the device allows contaminants from the operating room floor to enter the sterile surgery site and, as a result, cause patients to develop severe infections. Furthermore, the lawsuits allege that both companies intentionally concealed the risks and dangers associated with the Bair Hugger forced air warming device.
In December of 2015 the U.S. Judicial Panel on Multidistrict Litigation (JPML) consolidated Bair Hugger lawsuits in the U.S. District of Minnesota, MDL 15-2666, under U.S. District Judge Joan N. Ericksen. An MDL will allow the coordination of all pretrial proceedings and discovery for the lawsuits filed in Federal Court. There are currently more than 1,500 lawsuits pending in the MDL.
The first Bair Hugger trial is currently scheduled to begin on February 8, 2018.
