Our client “Jane”, 19 at the time, was a high school senior and accomplished musician who decided to participate in a blood drive at her school.
A phlebotomist employee of the blood center made the usual preparations and inserted a needle into Jane’s arm to start the blood draw, but was unsuccessful at finding a vein. Another blood center employee took over the procedure, making a second attempt to insert the needle into Jane’s arm and start the blood draw. During this second attempt, the needle was inserted far too deep into Jane’s arm and at a grossly improper angle. As a result, the needle pierced Jane’s median nerve. She immediately felt severe pain and a burning sensation in her hand and arm.
At that point, Jane was examined by a blood center supervisor and was told to go immediately to the emergency room. At the ER, Jane was advised to consult with her family physician the next day. After the incident, Jane had two surgeries on her arm and was advised by her neurosurgeon that the injury to her median nerve is permanent and irreparable. She has total and complete paralysis in her hand and two fingers and constant, intractable pain that responds only to nerve blocks that were administered every three months.
