What is a 3M Bair Hugger and why it may be dangerous?

McDonald Law Firm is currently investigating claims for individuals who are interested in pursuing a 3M Bair Hugger lawsuit. The Bair Hugger device is a forced-air warming warming blanket that is used during medical procedures to help maintain a patient’s body temperature and prevent hypothermia. It works by heating air and then pumping it through a hose into a surgical blanket covered with holes used to distribute the warm air over the patient. The device has been used extensively during shoulder, knee and hip replacement surgeries.

Does the 3M Bair Hugger device cause post-operative infection? McDonaldLawFirm.com

Does the device increase the risk of operating room contamination?

The alleged danger associated with use of the Bair Hugger device is that it disrupts “positive air flow” in the sterile environment of the operating room. The term “positive air flow” means that air comes down from the top of the operating room and pushes bacteria to the floor, keeping the area above the floor sterile from bacteria. The Bair Hugger device forces heated air into the operating room, and when the warm air rises from the floor, it carries with it bacteria that can enter the patient’s body and cause infection at the surgical site.

Serious infections possibly linked to use of the Bair Hugger device may include:

  • Deep-joint infections
  • Peri-prosthetic joint infections
  • MRSA
  • Sepsis

3M Bear Hugger Lawsuits

Patients across the country are now pursuing Bair Hugger lawsuits against 3M Company and its subsidiary, Arizant Healthcare, Inc. asserting that the device allowed contaminants to enter the surgery site and, as a result, caused patients to develop severe infections. Plaintiffs further allege that 3M Company and Arizant Healthcare have known the risks and intentionally concealed the dangers associated with the Bair Hugger device.

The lawsuits site several medical publications that expose the potential dangers associated with forced-air warming devices, including a 2013 article in The Bone & Joint Journal which highlights specific issues with the 3M Bair Hugger device, including that the heat from forced-air warming blankets can increase the temperature and concentration of airborne particles over the surgical site.

3M Bear Hugger MDL

On December 11, 2015, the U.S. Judicial Panel on Multidistrict Litigation (JPML) centralized Bair Hugger lawsuits in the District of Minnesota, MDL 15-2666, under U.S. District Judge Joan N. Ericksen.

As of January 2017 more than 1,100 lawsuits have been filed in the MDL.

  • Increased length of hospitalization
  • Additional hospital stays
  • Additional surgeries

What did 3M know and when did they know it?

As early as 2010, the New York Times reported that Dr. Scott Augustine, inventor of the Bair Hugger, warned of the dangers associated with using this device and advised surgeons and other physicians to quit using it during certain operations. Dr. Augustine found that the forced air warming system could cause the surgical field to become contaminated by airborne bacteria.

Did your post-surgical treatment involve the use of a 3M Bair Hugger forced air warming system?

The vast majority of hospitals in the United States use forced air warming during surgery, and 3M’s Bair Hugger is a market leader. If you had a knee, shoulder or hip joint replacement surgery in the past five years, a Bair Hugger may have been used, and it will be reflected in your medical records.

Is a 3M Bair Hugger lawsuit right for you?

Medical device manufacturers have a duty to adequately research, test, package, and label their products and warn the public of potential dangers. Manufacturers who rush to get unsafe products to market and put profit over patient protection could face legal liability.
